1. What the service is
Ultimate Diary is a personal journaling and record-keeping app: diary entries, "firsts", to-dos and projects, birthday reminders, a calendar, and a footprints map. When you choose to, it syncs your content to our servers so you can use it across devices and share books with other people.
It is made and run by an independent developer, not a company.
2. Your account
- You register with a working email address. Keep your password to yourself: anything done through your account is treated as done by you.
- You may have more than one account, but not for the purpose of getting around the free-tier limits.
- If you think your account has been compromised, change your password and contact us.
- You can delete your account yourself at any time. See §7 for what that does.
3. What you write is yours
- You keep every right in the content you create. We claim no ownership.
- You grant us a limited, non-exclusive, non-sublicensable licence for the sole purpose of storing, transmitting, backing up, encrypting and decrypting your content, and showing it to the people you have shared it with — that is, making the app work. The licence ends when you delete the content or your account.
- We will never use your content to train models, for advertising, for marketing, or to display anywhere.
4. Acceptable use
Don't use Ultimate Diary to:
- do anything unlawful where you are;
- store or distribute other people's personal information or confidential material that you have no right to hold;
- upload malware;
- hammer, scrape or attack our services through automated means;
- circumvent the subscription limits, or reverse-engineer the purchase mechanism;
- harass anyone, including by misusing book sharing to send unwanted material.
We may suspend or terminate an account that does these things, without prior notice.
5. Subscriptions and payment
- Ultimate Diary has a free tier and a Diary Pro subscription. The free tier caps the number of entries, books, and photos per entry; Pro raises or removes those caps.
- Subscriptions are sold through the Apple App Store as in-app purchases, and Apple takes the payment. Your Apple Account is charged on confirmation.
- Free trial. A first subscription, monthly or yearly, starts with a 1-month free trial, available once per Apple Account for this subscription group. When the trial ends, the price of the plan you chose is charged automatically and billing begins, unless you cancel at least 24 hours before the trial ends. Cancelling during the trial costs nothing.
- Subscriptions renew automatically. Unless cancelled at least 24 hours before the end of the current period, renewal is charged within the 24 hours before it ends.
- Manage or cancel in iOS Settings → Apple Account → Subscriptions. Deleting your account in the app does not cancel the subscription.
- Refunds are handled by Apple under Apple's policy. We cannot issue refunds ourselves, though you're welcome to contact us and we'll help where we can.
- Prices may change. You will be notified in advance and asked to consent as Apple's rules require, and you can cancel before any increase takes effect.
6. Sharing
- You can share a book with other people. Sharing means everything in that book is visible to them.
- Removing someone ends their future access only. It cannot recall what they have already read or saved. Choose carefully.
- You are responsible for the people you invite. Disputes arising from what you share are between you and them.
7. Your data, and deleting it
- Deleted entries sit in the trash and are permanently removed after 30 days.
- Deleting your account permanently erases everything you own, with no way to recover it. Export anything you want to keep first.
- A consequence of encryption: entry bodies are encrypted with a key held per book. If that key is lost, nobody — including us — can recover those bodies. That is how the encryption is designed to behave, not a malfunction.
8. Availability and liability
- The app is provided "as is". We work to keep it running, but we do not promise uninterrupted, error-free service, or that data will never be lost.
- Service may be interrupted for maintenance, upgrades, provider outages, or events beyond our control.
- Keep your own backups of anything that matters. Ultimate Diary should not be the only place something exists.
- To the fullest extent the law allows, we are not liable for indirect loss, lost data, or lost profits. Where liability cannot be excluded, it is limited to the subscription fees you actually paid us in the preceding 12 months.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
9. Ending things
- You may stop using the app and delete your account at any time.
- We may terminate an account for a serious breach of these terms. Unless the situation is urgent or unlawful, we will try to give notice first.
- If Ultimate Diary shuts down entirely, we will announce it in the app at least 30 days beforehand and provide a way to export your data.
10. Changes to these terms
We may update these terms. Material changes will be shown in the app. Continuing to use the app after a change means you accept it; if you don't, stop using the app and delete your account.
11. Governing law
- For users outside mainland China, these terms are governed by the laws of the developer's place of residence, without regard to conflict-of-law rules, and nothing here deprives you of the protection of mandatory consumer law where you live.
- Disputes should first be raised with us directly at the address below. We would much rather sort it out by email.
- If any provision is held unenforceable, the rest stays in force.
